The Andaman and Nicobar Islands have legislated which law prevails

On every other page of this desk, the shops Act and the OSH Code are shown side by side because which of them governs has not been settled. Here rule 12A settles it in terms.

The OSH Code applies to every shop or establishment with 10 or more workers; the Regulation applies from 20.
An establishment of twenty or more registered under the Regulation is deemed to have complied with registration under the Code, and no establishment the Code applies to registers separately under the Regulation.
For ten to nineteen workers the Code applies and the Regulation's registration provisions do not.
Where both cover an establishment, the Code governs occupational safety, health, working conditions and welfare, and the Regulation continues to apply to matters the Code does not expressly regulate.
On any inconsistency between the two, the provision more beneficial to the employee or worker prevails.

Who the Regulation applies to: Shops and establishments employing 20 or more persons, or that employed that many on any day of the preceding twelve months. Below twenty it does not apply — though the OSH Code does, from tenSection 1A, inserted by the (Amendment) Regulation, 2025
