ESI's ₹21,000 has no Code notification behind it
Section 2(89) of the Code has the wage ceiling notified for Chapter III and Chapter IV. Only Chapter III has been done — ₹25,000 by S.O. 5109(E), expressly “for the purposes of Chapter III”. No Chapter IV notification was found, and the Social Security (Central) Rules, 2026 contain no wage ceiling at all, so ₹21,000 rests on s.164(2)(b)'s saving of the rules under the repealed ESI Act, which runs one year from 21 November 2025. The 10-employee line and the 0.75%/3.25% rates are unaffected: the first is s.1(4) with the First Schedule, the second is rule 19 of those 2026 Rules.

Code on Social Security commenced; the EPF and ESI Acts are repealed
S.O. 5319(E) brought most of the Code into force on 21 November 2025, including Chapter III (provident fund) and Chapter IV (state insurance). Its table listed section 164 — the repeal — item by item, and S.O. 5936(E) of 19 December 2025 corrected that to the whole of section 164, except the parts already commenced by S.O. 2060(E) of 3 May 2023. So all nine enactments in s.164(1) are repealed, the EPF and MP Act 1952 and the ESI Act 1948 among them. Their schemes and rules survive only through s.164(2)(b), which holds them in force so far as not inconsistent with the Code for one year from commencement — to 21 November 2026.
