Delhi Shops and Establishments Act, 1954

Who registers

The occupier of every establishment, whatever its size. The Act sets no headcount below which registration is not requiredThis comes from the Labour Department's own copy of the Act at labour.delhi.gov.in. That copy is an annotated edition rather than a bare Act: each section is followed by editorial 'Comments' with case notes and the editor's glosses, and some of those glosses go further than the section above them — one, for instance, describes an 11 p.m. closing as optional, which section 16 does not say. Within ninety days — of the day the Act came into force for an existing establishment, or of the day a new establishment commences workSection 5(5)

What the statement contains

The employer's and manager's names, the establishment's postal address and name, its category — shop, commercial establishment, residential hotel, restaurant, eating house, theatre or other place of public amusement — and the number of employeesSection 5(1)(a) to (f)

The certificate

Issued by the Chief Inspector, displayed prominently at the establishment, and renewed at the intervals the rules prescribeSection 5(2) and (3)

Disputed category

A disagreement between the occupier and the Chief Inspector over an establishment's category is decided by the Government, and that decision is finalSection 5(4)
